Public Path Proposals at Wainhill Farm – Chinnor Footpaths 23, 24 and 40
As a result of a review of the Definitive Map and Statement, it appears the currently recorded legal routes of Chinnor FP23 and FP40 are incorrect because of a drafting error made when the 1999 Definitive Map was published. The Council plans to correct the Map such that it will run in a straight line between points E and F. The evidence on which this is based is set out in an investigation report which is available on request from countrysideaccesslegal@oxfordshire.gov.uk
By correcting the route’s alignment, it then removes FP40 from a 2.7m wide fenced route that the landowner has provided. The owners have therefore requested that, concurrently with the correction of FP23 and FP40, a separate diversion takes place to divert the path back to the provided route, which has a kissing gate at its northern end leading to the Chinnor and Princes Risborough railway. At the same time, the owners have requested the length of FP23 A – B - C on the diversion plan be diverted from the farmyard and running in front of their house and garden. The new route would be the length I – D - J to the rear of the property, which would give them greater privacy and security. The length of FP24 B - D would be extinguished from running across their garden to ensure a dead-end path does not remain. The new path running behind the house will provide them with greater privacy as the paths will not dissect their property and ensure the public and owners do not have safety issues in the farmyard as a consequence of moving vehicles and machinery. To effect this change, Orders would be made simultaneously. The attached consultation plan (HA1980/772c/03739) shows the diversion of the corrected line of FP40 shown as length E – G – H - F, the extinguished lines of FP23 and FP24 as A – B – C and B – D, and the new footpath as I – D - J.
The new routes cross grass at widths of 2.4m and 2.7m and have been provided by the landowner to enable walkers and consultees to view them. Kissing gates have been installed at Points I and G on the new routes, replacing three stiles along the current routes. The changes will take effect simultaneously, following which the Council will carry out signing for the new routes.
