We have confirmed an order to correct the legal alignment of Tadmarton Bridleway No. 5 (part) on the Definitive Map of Public Rights of Way.

Background

Public footpaths, bridleways, restricted byways and byways, open to all traffic are recorded on Definitive Maps and Statements. These maps and statements provide conclusive legal evidence of the existence of public rights. Oxfordshire County Council is responsible for the Definitive Map and Statement for Oxfordshire and has a duty to amend them when evidence suggests that they are inaccurate or incomplete. Such amendments are made by Modification Orders made under section 53 of the Wildlife and Countryside Act 1981. These Orders do not come into effect until confirmed. If there are no objections to the order, or if any made are withdrawn, the council may confirm the Order, and the Definitive Map and Statement will then be modified.

The Tadmarton Bridleway No. 5 (part) Modification Order 2025

The council made a Modification Order under section 53 of the Act to amend the alignment of part of Tadmarton Bridleway No. 5 on the definitive map and statement by: -

  • Deleting the section from the gate 45m to the east of Main Road Upper Tadmarton near Malcolm’s Cottage at grid reference SP 3959 3752 (Point A on the plan on the right hand side), running east north east for 52m to cross the brook at SP 3964 3753 (Point B), continuing east north east for 54m to SP 3969 3753 (Point C).
  • Adding a section from the gate 45m to the east of Main Road Upper Tadmarton near Malcolm’s Cottage at SP 3959 3752 (Point A), running north east for 50m to cross the brook at SP 3963 3754 (Point D), continuing north east and then south east for 71m to SP 3969 3753 (Point C).

Oxfordshire County Council made this Order because there is sufficient evidence to show that the alignment shown on the Definitive Map is incorrect. This Order amends the line on the Definitive Map onto that which is shown on the historic mapping. The evidence on which the decision is based is set out in the determination report which can be found on the right hand side.
