Consultation has concluded

To inform interested parties that the Modification Order to amend the alignment of Over Norton Footpath No. 2 has now been confirmed and so the footpath will be recorded on the Definitive Map and Statement.

Introduction

Public footpaths, bridleways, restricted byways and byways, open to all traffic are recorded on Definitive Maps and Statements. These maps and statements provide conclusive legal evidence of the existence of public rights. Oxfordshire County Council is responsible for the Definitive Map and Statement for Oxfordshire and has a duty to amend them when evidence suggests that they are inaccurate or incomplete. Such amendments are made by Modification Orders made under section 53 of the Wildlife and Countryside Act 1981. These Orders do not come into effect until confirmed.

The Over Norton Footpath No. 2 (part) Modification Order 2024

Oxfordshire County Council has made a Modification Order to amend the alignment of this footpath, by: -

1. Deleting a short section of the path from behind No 2 Penfield at OS grid reference SP 3152 2845, generally north-east for 82m to SP 3155 2852, and then continuing north-east for 64m to a point south of Sidelands, at SP 3159 2857.

2. Amending / adding the route of Footpath No. 2 from behind No 2 Penfield at grid reference SP 3152 2845, NE for 145m to a point south of Sidelands, at SP 3159 2857, then continuing NE to the edge of the Radbone Hill highway extent at SP 3163 2863.

These routes are shown on the Order plan, a copy of which can be found on the right hand side.

Oxfordshire County Council has made this Order because there is sufficient evidence to show that the Definitive Map is in error, that the legal line of Footpath No. 2 is currently recorded on the wrong alignment and stops short of the public road at Radbone Hill. This Order amends the legal line onto that which is in use on the ground and that was originally recorded by the Ordnance Survey 2nd Edition Map 1898, and the Parish Survey Map 1951. As a consequence, a short section of Footpath No 2 will be amended, and a further section will be added.

The County Council will consider all correspondence, objections and representations received in response to this order. They may be disseminated widely for these purposes and made available to the public. Privacy Notice Public Rights of Way, Commons and Town & Village Greens
